General Overview

The County of Northumberland, the owner and operator of the existing Brighton Landfill in the Municipality of Brighton, Ontario, has submitted an Environmental Assessment (EA) for the proposed expansion of the Brighton Landfill. The County of Northumberland is seeking approval for the proposed undertaking at the Brighton Landfill site, which includes the following objectives:

  • Increasing capacity to meet the lifespan objectives for the landfill;
  • and Fully lining the entire landfill using an engineered system to provide enhanced environmental protection.

The proposed undertaking will include lining the bottom of the existing Brighton Landfill to bring it up to modern waste management standards. The result will be a fully-lined landfill with enhanced leachate collection and an increase in disposal capacity. The undertaking requires approval under the Ontario Environmental Assessment Act. The purpose of the EA is to identify alternatives and study the potential effects of the proposed undertaking on the environment. 


Progress to Date

On June 7th, 2010 the County initiated the EA process by publishing a Notice of Commencement of the development of the Terms of Reference (TOR) for the EA.

On June 23rd, 2010 the first Open House was held, which introduced the project, the EA process and on-going consultation activities that will be part of this process to the public.

During the summer of 2010, a draft TOR was prepared.

On October 7th, 2010 a second Open House was held, where the draft TOR was summarized and discussed.

In October of 2010 the draft TOR was made available to the government review team, Aboriginal communities and the public for review and comment.

In January of 2011, the County submitted the TOR to the Ministry of the Environment (MOE) for its review. Members of the public, government review agencies, aboriginal communities and other interested parties were able to provide further comments on the TOR, to the MOE, during a 30 day public review period which commenced on January 28, 2011.

On April 20th, 2011 the Ontario Minister of the Environment approved the amended TOR for the proposed undertaking.

On June 13th, 2011, the County issued a Notice of Commencement of the EA for the Brighton Landfill.

On June 27th, 2011, a third Open House was held to provide information on the alternative methods of expanding and fully lining the landfill and details on the various EA criteria that would be used to assess the potential effects of the expansion and lining alternatives.

On November 29th, 2011, a fourth Open House was held to present and discuss the results of the environmental baseline studies and impact prediction assessment.

During the winter of 2012, a draft EA was prepared.

On June 20th, 2013 the draft EA was submitted to the MOE for comments and was posted to the County's dedicated website.

On September 6th, 2013 the EA was submitted to the MOE for review and approval.

On July 31, 2014, the Ministry of the Environment and Climate Change (MOECC), formerly the Ministry of the Environment (MOE), published its review report, titled "Ministry Review of the Brighton Landfill Expansion Environmental Assessment", along with a Notice of Completion of Ministry Review for the Environmental Assessment.

The Ministry are inviting the public to submit comments on the EA and the Ministry Review.  The deadline for submitting comments to the Ministry is Wednesday, September 3, 2014.

Next Steps

At the end of the comment period for the Ministry Review Report (September 3, 2014), MOECC staff will make a recommendation to the Minister of the Environment and Climate Change (Minister) concerning whether the EA has been prepared in accordance with the Term of Reference (ToR) and the requirements of the Environmental Assessment Act (EAA) and whether the proposed undertaking should be approved.  When making a decision, the Minister will consider the purpose of the EAA, the ToR, the EA, the Review, the comments submitted during the EA and the Review comment periods and any other matters the Minister may consider relevant.

The Minister may make one of the following decisions:

  • Give approval to proceed with the undertaking;
  • Give approval to proceed with the undertaking subject to conditions; or
  • Refuse to give approval to proceed with the undertaking.

Prior to making that decision, the Minister may also refer either part of or the entire EA to mediation or refer either part of or the entire EA to the Environmental Review Tribunal for a decision.

If the Minister approves, approves with conditions or refuses to give approval to the undertaking, the Lieutenant Governor in Council must concur with the decision.

The County is anticipating receiving the Minister's decision in December of 2014.
