Option 3: Trial Option

Two choices are available under this alternative.

1. Scheduling a First Attendance Meeting with the Prosecutor:

The County of Northumberland is designated to provide the option of a First Attendance meeting.

You can exercise this option by attending our Provincial Offences Office to fill in and file a form called "Notice of Intention to Appear".  This must be done in person or by an agent with your written authorization.

You may fill this form out at your local Provincial Offences Office only if they agree to put their court office date stamp on it and you do so within 15 days of receiving your ticket.  Once filled out and date stamped, the form may be faxed to our office at 905-372-6529 or mailed to us at 860 William Street, Cobourg, Ontario K9A 3A9.  We will not accept a Notice of Intention to Appear without a court office date stamp on it.

If you do not wish to go straight to court, you may print "First Attendance Requested" on the "Notice of Intention to Appear" form.  This will allow you to discuss your charge with the Prosecutor in a pre-arranged meeting in an effort to resolve the matter without going to a formal Trial. The investigating officer does not attend the meeting. If the matter cannot be resolved, your trial option remains available to you.

It is your responsibility to advise the court office of any change to your mailing address.

2. Scheduling of a Trial
The trial option requires you or your agent to attend the court office designated on the back of the Offence Notice to complete and file a Notice of Intention to Appear (NIA). A trial date will be set and a Notice of Trial will be mailed to you indicating your trial time, place and date. It is your responsibility to advise the court office of any change to your mailing address. Please note a trial cannot be requested by mail or phone.

If an agent is representing you, you must authorize the court, in writing, to mail the Trial Notice to your representative.
